1. Introduction and Acceptance

Welcome to BIB. These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your") and Superhero Panda Ltd, registered in England and Wales with company number 16790496, registered office at First Floor, Stanbridge Buildings, Stanbridge Road, Leighton Buzzard LU7 4QQ ("Superhero Panda", "we", "us", "our").

By accessing or using BIB - our vehicle history and intelligence service - you agree to be bound by these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE BIB.

1.1 Additional Policies

These Terms incorporate our Privacy Policy by reference.

1.2 Eligibility

You may only use BIB if you are at least 16 years old, have the legal capacity to enter into a binding contract under UK law, and are not prohibited from using our Services under applicable law.

1.3 Changes to Terms

We reserve the right to modify these Terms at any time. For material changes, we will notify you at least 30 days in advance via email or prominent notice. Continued use after changes take effect constitutes acceptance.

2. What BIB Is

BIB is a vehicle history and intelligence service for used car buyers in the United Kingdom. BIB allows you to search for a vehicle by its registration number and receive a detailed analysis drawn from that vehicle's official MOT test history.

What BIB provides:

  • MOT test history retrieved from the DVSA MOT History API
  • Analysis and intelligence derived from that history, including advisory tracking, reliability scoring, and peer-group comparisons
  • A Bib is a single credit entitling the holder to one full vehicle briefing

Data source

BIB retrieves MOT history data from the Driver and Vehicle Standards Agency (DVSA) via their official API. This is publicly available government data. Superhero Panda Ltd does not create, maintain, or control this data.

Important limitations

  • BIB's analysis is based solely on MOT test records. It does not include finance checks, insurance write-off history, stolen vehicle checks, keeper history, or any data source beyond DVSA MOT records
  • MOT history data reflects what was recorded by examiners at each test. It does not capture any work carried out between tests, any defects not identified at test, or the current condition of the vehicle
  • BIB is provided for informational purposes only. Nothing in a BIB briefing constitutes advice to purchase or not purchase a vehicle. You should conduct your own due diligence, including an independent mechanical inspection, before purchasing any used vehicle
  • The accuracy and completeness of MOT history data depends on DVSA records. We cannot guarantee that all records are complete, current, or free from error

3. User Accounts

To access BIB, you must create an account. You agree to provide accurate and complete information, keep your credentials confidential, be responsible for all activity under your account, and notify us immediately of any unauthorised access at support@superheropanda.com.

We will never ask for your password by email or phone.

4. Acceptable Use

When using BIB, you agree not to:

  • Violate any laws, regulations, or third-party rights
  • Submit false, misleading, or fraudulent information
  • Attempt to gain unauthorised access to BIB or other accounts
  • Use automated systems (bots, scrapers) to query BIB without our written permission
  • Use BIB to obtain vehicle history data for resale, commercial aggregation, or any purpose other than personal vehicle research
  • Interfere with or disrupt the operation of BIB
  • Upload viruses, malware, or harmful code

5. Intellectual Property

All intellectual property in BIB and its branding belongs to Superhero Panda Ltd or our licensors. This includes the BIB name, logo, and branding; platform software, code, algorithms, and AI technology; design, layout, and user interfaces; and all documentation and marketing materials.

You may not use, copy, modify, or distribute any of our intellectual property without express written permission.

MOT history data retrieved from the DVSA is Crown Copyright and subject to the Open Government Licence. BIB's analysis, scoring, and presentation of that data is proprietary to Superhero Panda Ltd.

6. Bib Credits and Payment

6.1 How Credits Work

BIB operates on a prepaid credit model. A Bib is a single credit entitling the holder to one full vehicle briefing. Credits are purchased in packs:

Prices shown are inclusive of any applicable taxes. We reserve the right to change pricing at any time; changes do not affect credits already purchased.

6.2 Credit Usage

One Bib is consumed the first time you access a full briefing for a vehicle. If you access the same vehicle's briefing again within your account, no additional credit is consumed. Credits are non-transferable between accounts.

6.3 No Expiry

Bib credits do not expire while your account remains active.

6.4 No Subscription

BIB does not offer a subscription model. You purchase credits as and when you need them.

6.5 Payment Processing

All payments are processed via Stripe. We accept credit/debit cards and other payment methods as indicated at checkout. You must keep your payment information current and accurate.

7. Refunds and Cancellations

7.1 Unused Credits - Cooling-Off Period

If you have purchased Bib credits and have not yet used any of them, you may request a full refund within 14 days of purchase. This is your statutory right under UK consumer law for digital content purchases.

7.2 Used Credits

Once a Bib credit has been consumed (a full briefing has been accessed), that credit is non-refundable. The digital content has been delivered.

7.3 Partial Refunds

If you have purchased a pack and used some but not all credits within 14 days of purchase, you may request a refund for the unused portion. We will calculate the refund based on the per-credit value of the pack purchased.

To request a refund, contact support@superheropanda.com within 14 days of purchase with your account email and order reference.

8. Privacy and Data Protection

Our Privacy Policy explains how we collect, use, and protect your personal data. Key points: we comply with UK GDPR and the Data Protection Act 2018; we do not sell your personal data to third parties; you have rights to access, correct, and delete your data.

9. Third-Party Services

BIB integrates with third-party services including Firebase (Google), Stripe, and the DVSA. We do not control, endorse, or assume responsibility for third-party content or services. Your use of third-party services is at your own risk and subject to their terms.

10. Disclaimers

BIB is provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, accuracy, and uninterrupted operation.

DVSA data accuracy: MOT history data is sourced from the DVSA. We do not warrant that this data is complete, accurate, current, or free from error. Discrepancies, missing records, or errors in DVSA data are outside our control.

Not purchase advice: BIB provides vehicle history information for research purposes only. Nothing in a BIB briefing constitutes a recommendation to purchase or avoid purchasing a particular vehicle. You are solely responsible for your vehicle purchasing decisions. We strongly recommend obtaining an independent mechanical inspection before purchasing any used vehicle.

Not a comprehensive check: BIB analyses MOT history only. It does not include outstanding finance, insurance write-off status, stolen vehicle status, number plate changes, or keeper history. For a comprehensive vehicle check, use a service that combines multiple data sources.

MOT pass is not a guarantee: A vehicle's MOT pass confirms it met minimum legal standards on the date of test. It does not guarantee ongoing roadworthiness, reliability, or fitness for purpose.

Nothing in these Terms affects your statutory rights under UK consumer protection law.

11. Limitation of Liability

To the maximum extent permitted by law, Superhero Panda Ltd shall not be liable for indirect, incidental, special, consequential, or punitive damages; loss of profits, revenue, or data; or personal injury or property damage arising from use of BIB.

Our total liability for all claims arising from your use of BIB shall not exceed the amount you paid us in the 12 months preceding the claim, or the value of the credit(s) giving rise to the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.

12. Termination

You may close your account at any time by contacting support@superheropanda.com. Unused Bib credits will be refunded only if account closure occurs within 14 days of credit purchase and the credits have not been used.

We may suspend or terminate your access if you violate these Terms, we are required to do so by law, your account has been inactive for an extended period, or we discontinue the Service.

13. Governing Law

These Terms and any disputes arising from them are governed by the laws of England and Wales. For businesses: the courts of England and Wales have exclusive jurisdiction. For consumers: you may bring proceedings in England and Wales or in the courts of the country where you reside.
